LAW 734 - Advanced Civil Procedure: Collective Litigation

Description: This course examines the procedural structures governing collective civil actions by consumers and employees against companies. The course covers the Federal Rules of Civil Procedure for class actions, the Federal Arbitration Act governing enforcement of arbitration clauses, arbitration providers’ rules for both individual and mass-arbitration claims, and additional procedural mechanisms by which plaintiffs can bring claims in collective and representative capacities. The course will incorporate both legal doctrine and public policy in its discussion of the benefits and downsides of collective action as a means to resolve civil disputes.
