LAW 299P - Fiduciary Litigation Practicum.


This practicum course will expose students to the burgeoning field of trusts and estates litigation – the litigation practice that focuses on trusts and estates controversies. Students will become familiar with the body of law governing the administration of estates and trusts, including most importantly the laws that define the fiduciary duties of trustees and other fiduciaries. Students will also become familiar with the professional responsibility concerns of lawyers who advise fiduciaries. Time permitting, the course will consider the malpractice concerns of lawyers engaged in a sophisticated trusts and estates practice. Students will act as counsel to both trustees and trust beneficiaries and, as such, will engage in many of the research, drafting, and counseling activities that are typical of this practice area.Five hours.Burke, Craddock, and Sims
